NPH Wins Civil Service Bypass Case for Worcester Police Candidate
The case involved the City's bypass of a candidate based on a nine-year old fight that took place in high school. The City bypassed our client when the mother of the other boy in the fight wrote a letter to the Chief of Police objecting to our client's appointment. The other boy also happened to be on the Civil Service list, just below our client. The mother's letter claimed that her son was an innocent bystander in the matter. However, during Attorney Nolan's cross-examination, the mother revealed that a District Court had in-fact found probable cause to issue a criminal assault and battery complaint against her son for the fight. To read the decision, click on the link below. Because some events occurred several years prior, when the parties were juveniles, names of involved parties have been redacted.
